Item Breaking the silence : restorative justice and child sexual abuse : a thesis presented in partial fulfilment of the requirements for the degree of Doctor of Philosophy in Social Policy at Massey University, Albany, New Zealand(Massey University, 2001) Jülich, Shirley JeanThis research investigated the relationship between justice and child sexual abuse from the perspective of adult survivors. Utilising participant observation, unstructured interviews and focus groups within a feminist framework, 21 adult survivors of child sexual abuse (18 women and 3 men) were consulted to identify issues that were problematic for them. In addition, 2 jurors, 1 judge and 2 counsellors were interviewed. The findings indicated that child sexual abuse has been shrouded by a conspiracy of silence, caused partly by deeply entrenched structures within society. These forces combined with the complexity of recovery, including the possible impacts of Stockholm Syndrome, and the perceived inability of the criminal justice system to meet their needs, have appeared to silence many survivors of child sexual abuse. A review of the economic consequences and an analysis of the subsequent costs of child sexual abuse have indicated the need to implement programmes that would lessen the burden for victims, offenders, their families and the broader society. Survivors cautiously suggested that restorative justice might be sufficiently flexible to encourage victims of child sexual abuse to criminally report, thereby breaking the silence. A cost benefit analysis of a restorative justice programme indicated that significant savings could be made and highlighted that the prevention of child sexual abuse should be a priority. The findings of this research would have implications for policy makers and all those who provide services to victims and offenders of child sexual abuse. Stockholm Syndrome has highlighted the complexity of the recovery process for victims of child sexual abuse. This syndrome combined with the concerns of adult survivors of child sexual abuse would have implications for practitioners within the traditional criminal justice system and the restorative justice movement. Finally, the costs of child sexual abuse in New Zealand would have implications for justice agencies, health agencies, social welfare organisations and the Accident Compensation Corporation of New Zealand.Item The impact of emergent development philosophies on formal British intervention in New Zealand between 1840 and 1842 : a thesis presented in fulfilment of the requirements for the degree of Doctor of Philosophy in Development Studies at Massey University(Massey University, 2001) Moon, Evan PaulBetween 1840 and 1842, the British Government commenced and then began to consolidate its formal colonial rule of New Zealand. Through the signing of the Treaty of Waitangi (1840) and the subsequent installation of the country's first Governor, New Zealand was directed predominantly by the British Government and evolved into a state which had growing political, social, and economic links with Britain. The primary objective of this thesis is to examine the way in which certain nineteenth century British ideas on development either influenced or were reflected in the nature of official British involvement in New Zealand between 1840 and 1842, and on British policy on New Zealand in the preceding decades. New Zealand was the last of the 'white' colonies to be established by the British Crown. Its period of annexation coincided with profound developments taking place in England in connection with ideas about the progress and improvement of nations, and of intentional rather than immanent development. New Zealand's early years of Crown Colony Government represent the convergence of all these factors within a very short space of time. The conclusion reached in this thesis is that formal British involvement in New Zealand - in the immediate period after the treaty of cession was signed - reflected the impact of contemporary ideas about development, and that there existed among some officials in New Zealand a distinct intent to develop the colony along the lines of these ideas. It is also apparent, however, that these philosophies were in some cases compromised because of shifting circumstances and insufficient resources to carry them through. Hence, in this period, the development of Maori and European in the colony failed to match the ideals of progress and development specifically prescribed by contemporary social philosophers, policy makers, and sometimes even the Crown's representatives in the colony.Item The quest for efficiency : role of human resource management in public sector reforms in Uganda : a thesis presented in fulfilment of the requirements for the Doctor of Philosophy in Development Studies at Massey University, Palmerston North, New Zealand(Massey University, 2002) Bacwayo, Kukunda ElizabethThe context of this thesis is the development strategy of public sector reforms and privatisation. It uses Uganda as a case study, and argues for the need to integrate the issue of human resource management in the privatisation discourse in developing countries. Public sector reforms arose out of neo-liberal thinking that argues against state intervention and recommends market led economic growth. Privatisation is part of the attempt to scale back on the role of the state in economic development and has been integrated in the development policies of developing countries through the structural adjustment programs of the IMF and World Bank. It is required because of the belief that the private sector is more efficient in allocation and use of resources and is therefore the best medium for attaining development goals. Private sector companies in the developed countries which utilise modern techniques of management are comparatively more efficient than their public counterparts. Globalisation and market competition forced organisations to search for ways to be competitive and this partly led to organisations elevating human resource management issues to a strategic level because of the belief that a company's workers add value that make firms competitive. When privatisation is made a requirement by the multilateral aid agencies for developing countries it is based on the assumption that the conditions that make public enterprises inefficient do not exist in the private sector. No empirical evidence is available to confirm or refute these assumptions, particularly in the case of Africa's developing nations. This thesis has contributed to this area by examining the human resource management practices of seven Ugandan organisations, three public, two private and two privatised. The aim was to find out whether there are differences in the way in which private and public organisations manage their employees and if their practices are those associated with effective management of human resources. The practices that were examined were recruitment and selection of staff, training, compensation and employee attitudes. The results from this study did not provide evidence that the differences that were exhibited in the seven organisations were related to ownership. Rather they seem to be determined by the values and culture of managers and the labour market conditions in Uganda. Both private and public enterprises exhibited practices that human resource management literature and practice consider as obstacles to efficiencyItem Women and local governance in Indonesia : a case study of engendering local governance in North Sumatra : a thesis presented in fulfillment of the requirements for the degree of Doctor of Philosophy in Development Studies at Massey University, Palmerston North, New zealand(Massey University, 2004) Siahaan, Asima Yanty SylvaniaThe main purpose of this thesis is to explore the complexities involved in engendering local governance and to identify strategies to encourage gender equitable partnerships between stakeholders in local governance in Third World countries. Local governance refers to the dynamic yet complicated process of interaction between state and non-state actors involved in local level development processes. Considering the invisibility of women in local governance, this study focuses heavily on women's agency, that is, the way women redefine and reconstruct identities and interactions in engendering local governance despite the given constraints. The central argument in this thesis is that engendering local governance requires transformation of structures and processes of governing at the local level so that they recognise and are responsive to differences between men and women in their values and responsibilities. Relevant institutions should then integrate these differences in policies and in managing development at the local level. Fieldwork in North Sumatra, Indonesia highlighted how the interlocking of public and private patriarchy complicates the engendering of local governance. Both within and beyond the household there are constraints put on women that impede their participation in local governance. Analysis of case studies of perwiridan (Moslem women's religious grouping), SPI (Serikat Perempuan Independen/ Union of Independent Women) and women working in local government found that relationships at the household level significantly influence gender relations in local governance. Reproduction of images of 'good' and 'bad' women is one of the most effective instruments to subordinate and control women in North Sumatra, meaning that it is not easy for women to formulate and defend their personal interests. Women often experience severe threats of physical, psychological and verbal violence when they attempt to influence formal decision making at the local level. Based on a further case study of the implementation of decentralisation, this study also found that decentralisation does not automatically bring local government closer to women due to the interweaving of structural, cultural, and financial barriers local government faces in implementing gender mainstreaming policies in North Sumatra. The intertwining of gendered structures of local government and gendered construction of the community contribute to the marginality of women in service delivery and in public decision making at the local level. This study rejects the assumption that women are passive recipients in local governance since they contribute significantly in fulfilling household and community needs and interests. Through knowledge and understanding to construction of power at the local level, women creatively produce and use alternative strategies which are based on their sexuality and traditional gender roles in challenging and transforming gender inequity at the local level and in improving the quality of everyday life. By raising women's self esteem, confidence and solidarity in reconstructing gendered relations at the household and community levels, women's grassroots organisations open up alternative arenas for political expression for women which is crucial for the realisation of good local governance.Item Labour standards under decentralisation and globalisation : the impact of the minimum wage policy in West Java, Indonesia : a thesis presented in partial fulfilment of the requirements for the degree of Doctor of Philosophy in Development Studies at Massey University, Palmerston North, New Zealand(Massey University, 2005) Surbakti, Indra MurtyThis study explores the importance of the minimum wage policy in West Java, Indonesia, within the overall framework of development and in the face of globalisation and decentralisation. A holistic approach to the minimum wage policy is applied. Generally, the study assesses the impact of decentralized minimum wage fixing processes on employment and participation of trade unions. In addition, it explores whether the minimum wage policy assists workers in coping with the negative effects of globalisation. It also explores the link between minimum wages and decent work. This study reveals that while there is some evidence of employment losses due to increases in wage levels in West Java, it did not find conclusive evidence that minimum wage levels were the main factor responsible for the employment decline. It is likely that a combination of factors such as a decrease in global demand for Indonesian manufacturing products and the current macro-economic conditions in the country, are also responsible for the employment decline. This study finds that the process of minimum wage fixing at local level has a positive impact on trade union participation in wage bargaining. The empowerment of trade unions through new legislation has enabled independent trade unions to flourish, which allows workers to join any trade unions. Consequently, minimum wage bargaining at district/city level is more dynamic than the centralized system of minimum wage bargaining in the past. Trade unions are able to express their views on what the minimum wage levels should be. Moreover, the minimum wage fixing processes at local level have the potential to promote decent work. The minimum wage fixing processes are an alternative to wage bargaining and can accommodate even sectors where trade unions are least active or non-existent. The minimum wage processes at district/city level are already established and they are in position to expand to a wider framework of providing welfare for workers. However, decent work objectives will not be achieved without the full cooperation of both central and local governments. Under the current decentralisation process, where central and local government views are still not in agreement, it is difficult to see how decent work can be applied nationally. Thus, the minimum wage policy and trade union development are important in the overall development paradigm. Both ensure the existence of a rights based approach to development where workers are given rights to organize as well as earn a basic living. Nevertheless, the development of trade unions in developing countries is under threat from flexibilisation of the workplace in which jobs have become less and less secure. The minimum wage policy, however, is still viable because it covers all types of workers. At the very least, minimum wages provide a safety net wage that can prevent real wages from falling. The writer suggests that more studies should be conducted on the extent and effectiveness of trade union participation in minimum wage bargaining. In addition, further studies should be conducted on the effect of minimum wages and trade unions on non-standard or flexible workers. Flexible workers, whether they are fixed-term contract and outsourced workers, are becoming an important part of the global labour market and increasingly pose a challenge to the increasingly important role of trade unions in developing countries.Item Corporate governance in the Indonesian state-owned enterprises : a thesis presented in fulfilment of the requirements for the degree of Doctor of Philosophy in Development Studies at Massey University, Palmerston North, New Zealand : a thesis presented in partial fulfilment of the requirements for the degree of Doctor of Philosophy in Development Studies at Massey University, Palmerston North, New Zealand(Massey University, 2006) Indreswari, MeidyahConcern regarding corporate governance is a new phenomenon in Indonesia. It became apparent in the business community when the economic crisis hit the country in 1997. Due to its recent recognition, it appears that very little is known about corporate governance in Indonesia and there has been no academic study conducted on corporate governance in the Indonesian Stateowned Enterprises (ISOEs) despite the fact that their performance is closely linked to the development of the country. The main objectives of this study are two-fold: first is to examine corporate governance systems and the roles of the Boards of ISOEs; and second is to assess the effectiveness of government initiatives in improving corporate governance practices in ISOEs. This study employed both qualitative and quantitative methods. The quantitative analysis was derived from numerical data obtained from government reports and other public documents. The qualitative analysis was based on the results of in-depth interviews with key individuals and other sources such as public opinions published in the mass media. Several key findings were obtained from the results of this study. Firstly, the study found that using agency theory to explain the relationships between the agents and the principals was more problematic in ISOEs than those in private enterprises. This is because an ISOE is a loose coalition of various agents with no real owner. Consequently. agency theory, if it is used to redefine the relationships among parties in ISOEs. should be approached at two different levels. At the micro level the agency theory examines the agent-principal relationships among the ISOE management, the Boards and the government-the corporate governance tripod. At the macro level it examines the agent-principal relationships between the corporate governance tripod and the ISOEs stakeholders (the public, labour unions, politicians in the People's Representative Assembly and others). Secondly, the results of this study confirm the results of previous studies which found that Boards in SOEs were largely ineffective. To enhance Boards' effectiveness, this study suggests that as a quasi-owner the government needs to reduce its intervention in ISOEs' operations and empower the Boards by establishing employee representation on the Board. In addition, Board training and assessment should be a mandatory in the ISOEs. Thirdly, this study found that the initiatives on corporate governance carried out by the Indonesian government had been ineffective due to the lack of incentives, lack of commitment and consistency, lack of understanding of corporate governance and unclear programmes. Here, the key factor required to enhance effectiveness is strong-willed commitment of the government and ISOE management. Lastly, other factors such as culture, public governance and law enforcement have a great influence in the process of attaining good corporate governance practices. Therefore, there should be joint efforts among parties in the public sector to ensure that good corporate governance is achieved in conjunction with the attainment of good public governance.Item Participatory approaches to development : an analysis of the experiences of development projects in Sudan : a thesis presented in fulfillment of the requirements for the degree of Doctor of Philosophy in Development Studies at Massey University, Palmerston North, New Zealand(Massey University, 2007) El Gack, Nawal El-GailiThis thesis aims to explore and analyse the experiences of participatory development projects in Sudan. The study focuses on participation in development, an issue that has attracted debate and discussion since the early 1970s. To contribute to this discussion and create more knowledge on this issue the White Nile Agricultural Services Project (WNASP) and North Kordofan Rural Development Project (NKRDP) were selected as case studies. Through various methods the nature and potential of participatory development approaches and interventions have been explored with the aim of identifying the factors that influenced people's participation, and suggesting ways to improve the practice of participatory development at grassroots level. The study found that although the projects encouraged and claimed to adopt participatory approaches, people were not engaged in a process through which participation could achieve empowerment or create real changes in their lives. The outcome of people's participation in the projects was influenced by development providers' policies, credibility and behaviour of staff, nature and amount of resources, socio-cultural norms, power relations, and communities' previous experiences, organisation and level of education. This suggests that primarily, designing participatory development programmes requires an in-depth understanding of prevailing social, economic, political and physical environments. Secondly, development providers should adopt approaches that accept negotiations with communities and challenge oppressive situations. Finally, if participatory development is to achieve its objectives, local communities must be provided with resources, information and skills. Based on evidence from powerful individuals in North Kordofan, this thesis suggests a moral-obligatory approach as one of the ways to improve the practice of participatory development in Sudan. This approach requires a fundamental change in development providers' policies, visions and credibility. If the essence of participatory development is adhered to, and if strategies and plans are designed collectively then there is an opportunity for making real change in the lives of those addressed by development interventions. This thesis concludes that more research is needed to explore the values, role, and impact of development providers and facilitators, as well as the nature and potential of local communities' participative values, organisations and practices.Item Maloafua : structural adjustment programmes : the case of Samoa : a thesis submitted to Massey University in fulfilment of the requirements for the degree of Doctor of Philosophy, Sociology Programme, School of Social and Cultural Studies, College of Humanities and Social Sciences, Massey University, Albany Campus, Auckland(Massey University, 2007) Kerslake, Maria TalaitupuStructural adjustment programmes have been promoted globally by international financial institutions as an answer to the financial problems of developing countries like Samoa. This thesis is a study of the history of structural adjustment programmes in the Independent State of Samoa, and focuses specifically on a case study of one particular programme: the restructuring and privatisation of the former Public Works Department (PWD). It seeks to compare the claims made for the reform process by development economists, development consultants and planners, politicians and reform managers, with the experiences of those who were involved in various roles in a particular type of reform: the privatisation of a Government utility. The PWD was chosen by the Samoan Government to kick-start its institutional reform programme. The Department had, over the years, suffered from poor management, corrupt practices, overspending and unaccounted funds which were all revealed in an Auditor General's Report tabled in Parliament in Samoa in 1994. This caused great embarrassment to the Government which had then to respond to these accusations. Government saw the reform of the PWD as a means to respond to public criticism of its lack of oversight, and discontent with the standard of the department's services in public works, institutional construction, repair and maintenance programmes. The study used a case study methodology to interview the people that were involved in the privatisation of the old Public Works Department (PWD). Various people who were, and are still, involved in the process of reforming Government institutions were interviewed. These included the politicians who both advocated and opposed the implementation of the reforms, the consultants who managed them for the Government and international agencies, and employees at all levels of the former Public Works Department. It explored PWD employees' personal and institutional experiences of the period before, during and since the reform of the agency. Despite the propaganda on the benefits that reform programmes have for the countries that implement them, the study has revealed different findings. It identifies and examines some important differences between the claims made by various stakeholders about the reforms, and the experiences of those who were directly involved in various ways. It has shown that people in different positions have different experiences of the same programmes, and that their experiences are significantly influenced by their social location and, specifically, whether they are "insiders" or "outsiders." It concludes by suggesting that since the structural reform project is likely to continue in Samoa for the foreseeable future, it is useful to identify those lessons from the PWD privatisation which might be applied to future projects to mitigate their social and organisational impact.Item The role of the military within Official Development Assistance : policies, parameters and procedures : a thesis presented in partial fulfillment of the requirements for the degree of Master of Philosophy in Development Studies at Massey University, Palmerston North, New Zealand(Massey University, 2009) Bennett, Vernon NoelThis thesis explores the relationship between development, Official Development Assistance (ODA) and the military in order to determine both the nature and effects of that relationship, and how the involvement of the military within ODA can be conducted in the most appropriate manner to support development. This study was conducted with regard to the current links between security and development within international relations and concerns that ODA is being drawn from a primarily development role to one that more explicitly supports national foreign and security policy ends instead. This issue is explored by defining development, ODA and the military as separate variables and then employing a grounded theory approach to develop an understanding of the relationship between them. The results of the study show that the involvement of the military within ODA and development may occur throughout the full range of operational contexts in which the military may be employed and can encompass activities throughout the scope of the functions of development. This involvement can in turn create a range of positive and negative impacts upon the conduct of ODA and development as the military serves to moderate the direction and strength of the relationship between the two. From this, the role of the military within ODA is identified as potentially an enabling, implementing and coordinating agency – primarily during times of crisis and conflict. The study then relates this role back to the wider context through considering the management of the military’s role and identifying the policies, parameters and procedures that may help to ensure that this role is conducted in the most appropriate manner for development.Item Rūnanga : manuka kawe ake = Facilitating Māori aspirations : a thesis presented in partial fulfilment of the requirements for the degree of Master of Arts in Development Studies at Massey University, Palmerston North, New Zealand(Massey University, 2004) Warren, Krystal Te Rina FainThis thesis examines the location and role of the runanga institution. As a prominent contemporary organization for Maori development, relevant theory locates runanga with regard to a broader developmental framework and their potential to function within it. The position of runanga, as a facilitator of Maori development, is assessed with reference to Dependency theory, World Systems theory and Modes of Production. These theories highlight the systematic historic dis-empowerment of Maori through the processes of colonisation with particular regard to runanga. The thesis also considers the evolution of the runanga since its migration from Hawaiki, its utilisation as a forum of colonial resistance, its co-option into the governmental system and its contemporary resurgence. This provides a historical overview of the runanga as an institution. In addition, Te Runanga 0 Ngati Whitikaupeka has been used as the case study which considers the issues of becoming a runanga and includes what the structure of the runanga might look like for Ngati Whitikaupeka as an iwi. The theories of Community Development and Empowerment are offered as means to counter the further dis-empowerment of Maori, where institutions such as runanga can utilise these notions to facilitate positive outcomes for iwi and Maori development. Field research contained in this thesis identifies some of the specific concerns and aspirations of Ngati Whitikaupeka iwi members. In utilising the notions of empowerment and community development the field research provides an explicit statement of Iwi aspirations to maintain the connection between Ngati Whitlkaupeka Iwi members at the flax-roots and Te Runanga 0 Ngati Whitikaupeka as a representative body that can facilitate those aspirations. Supplementary to this the iwi aspirations that have been identified in this study are intended to provide some direction for the runanga as the representative decision-making body moving into the future.
